MOTOR FLEET POLICY

The details contained herein are a summary of the cover provided to customers of Bellhire plc when taking a rental package which includes comprehensive insurance cover. These details are for information and guidance only and shall not be considered a contract or binding upon Bellhire plc.

Comprehensive

Persons or classes of persons entitles to drive:

  1. Any person who has entered into a hire contract with the Policyholder (Bellhire plc) for the hire of the vehicle and complies with the standard conditions laid out below.
  2. Any Additional Driver who has completed and had accepted, a supplementary motor insurance form in connection with the hire of the vehicle by a person referred to in 1. above and who complies with the standard conditions laid out below.

If you fall with in the following list of persons and/or occupations, you must contact the reservation centre on 0208335 0060 before reserving a vehicle as certain restrictions may apply:

  • Any person whose license has been endorsed or is pending with the following motoring conviction codes UT10 thru UT50.
  • Any person engaged in the following occupations:- Entertainers (Theatre, TV, film etc.). Gambling, gaming and Night-club operators. Armed forces personnel, Professional Sportspeople, trainers and managers.
  • Students under the age of 23.

Standard Conditions of entitlement to drive under this policy:

All drivers must be over 21 and have held a full, clean British licence for a minimum of 12 months prior to hiring (24 months if 23 or under). If you have received more than two speeding or minor driving convictions in the last three years or have more than 6 points on your licence, then please refer to the Reservation centre on 020 8335 0060 before making your reservation.

Standard conditions with the exception that you must have held a full valid license for a minimum of 24 months.

Foreign licences are acceptable  (subject to an additional £200 Excess) providing:

  1. The licence is clearly valid for the class of vehicle required.
  2. The licence includes an English translation or you also hold a valid international driving permit
  3. Holders of European Union licences are entitled to drive within the European Union indefinitely. All other foreign licences are restricted to a maximum of 12 months for non residents of the UK and 4 months for residents.

Use
Limitations to Use by the Hirer:

  1. For the business or trade purposes by any person to whom the vehicle is let on hire by the policy holder (Bellhire plc) and who has completed and had accepted an approved drivers or supplementary motor insurance form..
  2. For Social Domestic and pleasure purposes by any person to whom the vehicle has been let on hire by the Policyholder (Bellhire plc) and who has completed and had accepted an approved drivers or supplementary motor insurance form.

However, the following uses are not permitted:-

  1. Racing, pace making, speed testing, competitions, trials or rallies (apart from road safety rallies and treasure hunts).
  2. Motor trade unless your vehicle is in the hands of the motor trade for service, upkeep or repair, or unless this use is described in your Certificate of Insurance.
  3. The carriage of passengers for hire or reward.

All sections are subject to the terms, conditions, exceptions and endorsements of this insurance.

SECTION 1 - LIABILITY TO THIRD PARTIES

If death or bodily injury is caused out of the use of the Insured vehicle the Company will insure you for all sums which you become legally liable to pay.

If damage to property is caused out of the use of the Insured vehicle, the Company will insure you for all sums which you become legally liable to pay, up to a maximum of £5,000,000 for Commercial Vehicles in excess of 7.5 tons and Minibuses, and up to a maximum of £20,000,000 for Private Cars and Commercial vehicles not exceeding 7.5tons, in respect of any one claim or series of claims arising out of one cause.

Cover provided for other people
The Company will also insure the following people under this section of the insurance:-

  1. Any person who has entered into a Hire Contract with the Policyholder for the hire of the vehicle, other than any person excluded by an endorsement, exception or condition of this Insurance.
  2. Any additional driver who has completed a supplementary motor insurance proposal form in connection with the hire of the vehicle by a person referred to in Paragraph 1 above.
  3. Any person in the Policyholder’s employment under a contract of service whose employment is engaged in the letting or hire of vehicles by the Policyholder and who is driving on the order or permission of the Policyholder.
  4. Any person who causes an accident while travelling in or getting into or out of your vehicle provided you ask the Company in writing to indemnify the person.
  5. If any person insured by this insurance dies the Company will deal with any claim made against their estate, provided that the claim is covered by the insurance.

Legal, costs and other expenses
Providing that you have the Company’s written permission beforehand they will pay the following for any accident that involves legal liability under this insurance:-

  1. The reasonable costs of legal services to defend any person insured by this insurance against proceedings taken for manslaughter or causing death by dangerous driving.
  2. Solicitor's costs for representing any person insured by this insurance at a coroner's inquest or fatal accident enquiry.
  3. All other costs and expenses that you incur with the Company’s written consent.

Emergency Medical Treatment
The Company will pay for any Emergency Treatment Fee as required under the Road Traffic Act for injuries resulting from any accident involving a vehicle insured by this insurance.

Exceptions to Section 1
The Company will not provide cover for the following:-

1.

Death of or bodily injury to the driver.

2.

Liability for causing the death of or injury to any employee arising out of and in the course of employment by any person insured under this insurance if the liability is covered by an employer’s liability policy.

3.

Liability of any person covered by this insurance if that person is entitled to indemnity under any other insurance.

4.

Loss of or damage to vehicles or other property owned by or in the care of any person insured under this section of the insurance.

5.

Death or bodily injury or loss or damage caused or arising:

 

(a)

in connection with the bringing of the load to your vehicle or loading thereon or the taking away of the load from your vehicle after unloading by any person other than your driver or the attendant of your vehicle.

 

(b)

beyond the limits of any carriageway or thoroughfare in connection with the bringing of the load to your vehicle or loading thereon or the taking away of the load from your vehicle after unloading.

6.

Any vehicle whilst "airside" at any airport or airfield, i.e. in an area where aircraft are to be found landing, taking off, manoeuvring or parked etc.

7.

Any claim arising during or in consequence of an act of terrorism other than to meet the requirements of the Road Traffic Act.  For the purpose of this exception, terrorism means an activity involving a violent or life threatening act by an individual or organisation with the intention of coercing, intimidating or influencing either an individual person, the civilian population, or the Government of any country, or any act deemed by any law enforcement body to be an act of terrorism.

SECTION 2 - LOSS OF OR DAMAGE TO THE VEHICLE
The Company will insure you against loss of or damage to your vehicle occurring in the United Kingdom caused by:-

(a)

Accidental external and visible means.

(b)

Frost (provided all reasonable precautions are taken).

(c)

Vandalism or malicious means.

(d)

Fire, lightning, self ignition, or explosion.

(e)

Theft or any attempt thereat.

The Company will insure you against loss of or damage to your vehicle occurring in the United Kingdom caused by Theft, or any attempt there at providing the vehicle has been adequately secured against such a threat and objects of value have not been left on display to attract potential thieves. 

Reporting an incident on the vehicle:

All accidents or incidents involving theft, fire or damage must reported to Bellhire plc within 4 hours of the incident. Bellhire can be contacted on 020 8335 0060 during normal working hours or there insurance representatives can be contacted on 0800 328 9076. Bellhire or their representatives will give you advice and assistance on what to do and onward provision.

Audio equipment

The Company will insure you against loss of or damage to audio equipment permanently fitted to the vehicle but is subject to the policy excess as detailed on you rental agreement.

Windscreen and Windows

If the windscreen or windows of your hire vehicle are broken, normal damage cover applies subject to the policy excess as specified on your rental agreement.

Exception to Section 2
The Insurance does not cover:-

1.

Loss of use, wear and tear, betterment, depreciation, mechanical, electrical, electronic, computer, failures or breakdowns or breakages or damage to tyres unless resulting from an accident to your vehicle.

2.

Loss of or damage arising from theft or attempted theft if the ignition keys and/or security equipment arming devices have not been activated or have been left in or on the vehicle or easily accessible.

3.

Loss of or damage to cassettes, compact discs, money, stamps, tickets, documents or securities, jewellery, radio, mobile or portable telephones, two way transmitters, television receivers, video recorders, sound reproducing equipment, Traffic Master systems, portable Satellite Navigation or similar units.

4.

Any goods, samples, tools or equipment carried in connection with any trade or business.

5.

Any amount which is more than the last known list price of any part or accessory which is obsolete or unobtainable.

6.

Any reduction in the market value as a result of repairs to the vehicle.

7.

Loss or damage caused by any person obtaining the vehicle by deception.

8.

Any property insured under any other contract of insurance.

9.

Loss or damage where adequate precautions have not been taken.

10.

Replacement of locks if the keys are stolen or lost.

11.

Damage to the insured vehicle/trailer caused by the produce and/or livestock carried therein.

12.

Any amount exceeding £250,000 in respect of any one claim or number of claims arising during or in consequence of an act of terrorism.
For the purpose of this exception, terrorism means an activity involving a violent or life threatening act by an individual or organisation with the intention of coercing, intimidating or influencing either an individual person, the civilian population, or the Government of any country, or any act deemed by any law enforcement body to be an act of terrorism.

SECTION 3 - FOREIGN USE
Providing you have notified us in advance that you will be travelling to a specified country abroad and we have given permission and supplied the necessary documentation, the Company will insure you, as described above, against accident, injury, loss or damage occurring in:-
(a)

any member country of the European Union (E.U.).

(b)

any other country in respect of which the Commission of the E.U. has made arrangements to meet the requirements of Article 7 (2) of the E.U. Directive on insurance of civil liabilities arising from the use of motor vehicles. The Company reserves the right to charge for this provision.

(c)

any other country in which the Company agree to provide cover, following a request from the Insured but only for the period agreed by the Company.

The Company will also provide cover for your vehicle/s while in transit (including loading and unloading) by any recognised sea or rail route of not more than 65 hours duration under normal conditions between ports or terminals therein.
For all countries outside the territory of the United Kingdom a European Travel Document will be issued by the Company (for a period not exceeding 45 days) and an additional premium may be charged.

The following list of countries is for guidance only and is subject to change without notice:

  • E.U. Countries:
    Austria, Belgium, Bulgaria (green card required), Czech Republic, Cyprus, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Republic of Ireland, Romania (Green Card Required), Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Slovakia, Slovenia, Spain, Sweden
  • Non E.U. Countries who have signed the E.U. “Multilateral Guarantee Agreement” on motor insurance - (Green Card required):
    Iceland, Norway and Switzerland (including Liechtenstein).
  • Other Countries Under The Green Card System For Which Cover May Be Granted (Subject to prior agreement).
    Andorra, Belarus, Croatia, Macedonia (F.Y.R.O.M.) and Turkey.

Bail Bond

The Company authorises the M.I.B. of Madrid to act on your behalf to obtain the release of your vehicle and/or the person authorised to drive the vehicle from official detention following an accident.  To this effect the M.I.B. of Madrid is hereby authorised to make guarantees or deposits up to £2,000.  Immediately the guarantee is released or the deposit becomes recoverable you and/or the authorised driver must comply with all necessary formalities and give the Company all information and assistance required to obtain the cancellation of the guarantee or the return of the deposit.  If the guarantee or deposit is wholly or partly forfeited or taken for the payment of fines or costs in or as a result of any penal proceedings against you and/or the authorised driver, you will repay such amount to the Company as soon as possible.

SECTION 4 – EXCESSES

(a)

Accidental Damage       

Standard Excess as shown on your Rental Agreement.

(b)

Fire

Standard Excess as shown on your Rental Agreement.

(c)

Theft/Attempted Theft

Standard Excess as shown on your Rental Agreement.

(d)

Windscreen/Windows    

Standard Excess as shown on your Rental Agreement.

(e)

Overhead damage on LCV’s and Minibuses

Excess of £3,000. This excess is not reduced by any Excess Waiver

If a loss or damage occurs to your vehicle including accessories while it is being driven by or is in the custody or control of a person who has had special conditions applied the above excess is payable in addition to any special conditions imposed.

SECTION 5 - CROSS LIABILITIES
In respect of claims under Section 1 of this insurance each of the Insureds mentioned in the contract shall be deemed Third Parties to each other.

GENERAL EXCEPTIONS
This insurance does not cover:-

1.

Any accident, injury, loss, damage or liability when a vehicle insured by this insurance is:-

 

(a)

being used for a purpose not in accordance with the use clause in the Certificate of Insurance and/or Schedule/amended Schedule.

 

(b)

being driven by you unless you hold a licence to drive the vehicle or have held and are not disqualified from or prohibited by law from holding or obtaining such licence.

 

(c)

being driven with your permission by any person who and who has not completed and had accepted an approved drivers or supplementary motor insurance form

 

(d)

in any country outside the United Kingdom, apart from those covered under Section 3 (foreign use).

2.

Loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any of the following regardless of any other cause or event contributing concurrently or in any other sequence to the loss, except so far as is necessary to meet the minimum requirements of the Road Traffic Act (notwithstanding any provision to the contrary within this insurance or any endorsement thereto) ; war, invasion, acts of foreign enemies, hostilities or warlike operations (whether war be declared or not), civil war, rebellion, revolution, insurrection, civil commotion assuming the proportions of or amounting to an uprising, military or usurped power.

 

This exception also excludes loss, damage, cost or expense of whatsoever nature directly or indirectly caused by, resulting from or in connection with any action taken in controlling, preventing, suppressing or in any way relating to the above.
If the Company alleges that by reason of this exception, any loss, damage, cost or expense is not covered by this insurance, the burden of proving the contrary shall be upon the Insured.
In the event any portion of this exception is found to be invalid or unenforceable, the remainder shall remain in full force and effect.

3.

Accident, injury, loss, damage or legal liability which occurs as a result of:-

 

(a)

pollution or contamination however caused except so far as is necessary to meet the minimum requirements of the Road Traffic Act.
For the purposes of this exception, pollution or contamination shall be deemed to mean:

 

 

i)

all pollution or contamination of buildings or other structures or of water or land or the atmosphere and

 

 

ii)

all death, bodily injury, illness, loss or damage directly or indirectly caused by such pollution or contamination

 

(b)

ionising radiation or contamination by radioactivity from any irradiated fuel or from any nuclear waste from the combustion of nuclear fuel or any consequential loss therefrom.

 

(c)

the radioactive, toxic explosive or other hazardous properties of any nuclear assembly or nuclear component of such assembly or any consequential loss therefrom.

 

(d)

an earthquake.

 

(e)

riot or civil commotion occurring outside England, Scotland, Wales, the Isle of Man or the Channel Islands except so far as is necessary to meet the minimum requirements of the Road Traffic Act.

 

(f)

pressure waves caused by aircraft and other aerial devices.

 

(g)

any vehicle covered by this insurance being in an unsafe, unroadworthy or illegal condition.

 

(h)

any vehicle covered by this insurance being used, driven or taken away by any member of your family or the family of the authorised driver of the vehicle  who has not completed and had accepted an approved drivers or supplementary motor insurance form

4.

Consequential Loss to you arising directly or indirectly from any accident, damage, injury or loss.

5.

Any deliberate damage done to any property by you or by any employee or partner and which was done with your consent or prior knowledge.  Deliberate damage caused as a result of a reasonable attempt to save life or to prevent further damage being caused to any property already insured under this policy, will not, at our discretion, be excluded by this clause.  Our obligations under the terms of the Road Traffic Act to any third party will not be affected by this clause, however we reserve the right to recover any such sums paid by virtue of the provisions of the Road Traffic Act but which would otherwise be excluded under this clause, from you.

6.

Any liability if you deliberately use your vehicle to cause loss, damage or injury to any person.  Our obligations under the terms of the Road Traffic Act to any third party will not be affected by this clause, however, we reserve the right to recover any such sums paid by virtue of the provisions of the Road Traffic Act but which would otherwise be excluded under this clause, from you.

7.

Any claim occasioned by or arising from suicide or attempted suicide except so far as is necessary to meet the requirements of the Road Traffic Act.

GENERAL CONDITIONS

1.

This insurance will only apply provided that:-

 

(a)

any person claiming indemnity has complied with all the terms, conditions and endorsements of this policy.

 

(b)

the declaration and information given on your proposal form, is complete and correct to the best of your knowledge and belief and any change in circumstance or personal position or condition which may affect the insurance is notified to Bellhire plc within a reasonable period.

2.

When an accident incident or loss or damage occurs you or your personal representative must:-

 

(a)

advise the Bellhire plc in writing giving the Company full details as soon as reasonably possible by completing an Accident Report Form.

 

(b)

wherever possible obtain the names and addresses of all witnesses.

 

(c)

send Bellhire any letter, claim, writ or summons immediately it is received, unanswered.

 

(d)

advise Bellhire in writing immediately of the time and place of any impending prosecution, coroner's inquest or fatal accident enquiry involving any person covered by this insurance.

 

(e)

make no admission, offer, repudiation or promise of payment without Bellhire’s written permission.

 

(f)

provide Bellhire with all such information, co-operation and assistance as they may reasonably require.

3.

Bellhire plc and it’s Insurers are entitled to take sole control to conduct in your name or in the name of any person insured by this insurance:-

 

(a)

the defence and/or settlement of any claim.

 

(b)

proceedings to recover any payments made under this insurance.

4.

The Company may cancel this insurance by giving 7 days’ notice by Recorded Delivery letter to your last known address.  You must return the Certificate of Insurance to us within the seven days mentioned herein.

5.

If the law of any country in which this insurance applies obliges the Company to pay a claim they would not otherwise have paid, the Company reserve the right to recover this amount in full from you or from the person who received the liability.

6.

If at the time of the happening of any accident, injury, damage or loss covered under this insurance there is another insurance in force covering the same liability, loss or damage whether effected by you or not the Company will pay only their share of the claim.

7.

You and any person claiming indemnity under this insurance must take all reasonable steps to:-

 

(a)

safeguard the insured vehicle and its contents from, fire, theft, conversion or other loss or damage.

 

(b)

maintain the insured vehicle in an efficient and roadworthy condition.  The Company shall have at all times by their authorized representative free access to examine the insured vehicle.

8.

If by reason of it’s age you must have in force a valid M.O.T. Certificate, regarding the roadworthiness of the insured vehicle, failure to have such a document could lead to a claim for the total loss of the insured vehicle being repudiated.

9.

If a part of this document is proven to have no legal validity all other parts of the document will be considered as valid in Law unless proven otherwise.  We reserve the right and without notice to replace any part of this document proven not to be valid in Law with a wording that is.
